The Justice Department filed a legal brief Tuesday defending the decision, arguing the outlets failed to meet professional journalistic standards. The administration's court filing cited specific articles from each outlet, including reports on Iran war status, depleted US ammunition stockpiles, and an investigation into a leak about FBI Director Kash Patel. However, the letters sent to the outlets were unsigned, lacked official letterhead, and did not claim any cited stories contained classified information. Some examples, like a Politico piece describing an unpleasant atmosphere at the Texas Republican convention, appeared unrelated to national security. The Justice Department is asking courts to overturn the 49-year-old Sherrill v. Knight precedent guaranteeing press equal access to White House spaces, instead citing a recent DC Circuit ruling allowing selective access restrictions to sensitive areas like the Oval Office. The three outlets sued Monday, and a hearing is scheduled for Wednesday before Judge Timothy Kelly, who previously ruled in CNN's favor during a similar 2018 credential dispute.
