Judge Signals Due Process Concerns Over Trump's White House Press Bans
A federal judge said he will rule “as soon as I can” on whether to restore White House access for CNN, Politico, and MS NOW after President Donald Trump banned them over their coverage. The decision follows a 45-minute hearing on Wednesday. U.S. District Judge Timothy Kelly noted he is bound by D.C. circuit precedent on White House access, citing the 1977 Sherrill vs. Knight decision and the 2020 Karem vs. Trump ruling. He stated that based on precedent, proper procedure “wasn’t followed here,” and he previously presided over a CNN lawsuit involving Jim Acosta’s revoked pass. Kelly ruled in that earlier case that Acosta’s pass had to be restored because he was not given notice. The judge’s comments suggest due process concerns may factor into his upcoming decision on the current ban.
