Judge Timothy J. Kelly, a Trump appointee, previously handled a similar 2018 case involving expelled journalists, restoring their credentials on procedural grounds without ruling on free speech violations. According to the legal organization Lawfare, there are currently 356 ongoing lawsuits between the Trump administration and third parties, with this case being the latest. The judge appeared skeptical during the hearing but has deferred his decision.
