Dallas police update marijuana possession policy to decriminalize small amounts
Dallas police have updated their policy on marijuana possession. Officers can no longer arrest or issue citations for possession of four ounces or less. This replaces the previous rule, which allowed confiscation but not citations for under two ounces. The change follows the passage of Proposition R, known as the “Dallas Freedom Act,” which received 66% support in the November election. The new policy prohibits using the smell of marijuana as probable cause for searches, except in serious felony cases. Despite this change, marijuana remains illegal in Dallas under Texas law. Possession of two ounces or less is still a Class B misdemeanor, while possession of two to four ounces is a Class A misdemeanor.
