SC upholds SIT formation against Jai Corp’s director
The Supreme Court has denied a request from Anand Jain, a director at Jai Corp Ltd, to challenge a decision by the Bombay High Court. The High Court ordered the Central Bureau of Investigation (CBI) to form a special investigation team (SIT) to look into allegations of missing over Rs 2,000 crore. The Supreme Court justices stated they would not interfere with the High Court's decision. They allowed Jai Corp and Jain to explore other legal options. This order followed a petition from Richie Sequeira, an NGO member, who raised concerns about Jain's actions dating back to late 2021 and 2023. The High Court expressed its wish to ensure public confidence in the investigation process. Jain's lawyer described Sequeira's petition as an abuse of the legal system. However, the Supreme Court noted that the objective of the petition was for the Economic Offences Wing of the Mumbai police to conduct a preliminary inquiry into the allegations against Jain. The Supreme Court supported the High Court’s conclusion that a preliminary inquiry was necessary. The CBI's director in Mumbai has been instructed to execute the High Court's orders and investigate the case properly. During the hearing, lawyers for Jain attempted to challenge the High Court's ruling, but the Supreme Court emphasized the nature of the allegations. They mentioned serious accusations, such as misappropriating public funds and deceiving investors. The Supreme Court urged that the SIT investigation should be conducted fairly and impartially, without bias. The Supreme Court also acknowledged that the accused have the right to request a quashing of the FIR registered against them, indicating that the courts will evaluate such requests fairly and independently.
