Prosecution drops rape charges against Santa Cruz County real estate broker
The prosecution has dropped all charges against Frank DeBernardo, a Santa Cruz County real estate broker, who was accused of raping an unconscious family friend after a 2021 party. The Assistant District Attorney cited insufficient evidence as the reason for the dismissal. The charges included rape of an unconscious victim and witness intimidation. Although the case is closed for now, the prosecution may consider refiling if new evidence emerges. DeBernardo's attorney stated that the alleged victim admitted to lying under oath during preliminary hearings. DeBernardo acknowledged a sexual encounter with the victim but claimed it was consensual. A civil case related to the matter is scheduled for January 31.
