Hotel unfairly dismissed manager, but pays compensation
A hotel night manager, fired for bullying a gay colleague, has been awarded €3,000 for unfair dismissal due to a procedural error. The Workplace Relations Commission (WRC) found the dismissal was unfair because the employer missed his appeal email. The WRC determined the hotel was justified in firing Omar Mohammed Osman for bullying, including calling the colleague names and mocking his accent. However, the company failed to acknowledge or respond to Osman's email requesting an appeal of the decision. Osman denied the allegations and claimed he was unfairly targeted for raising concerns about management. The WRC found his behavior caused distress to his colleague, but the procedural error led to the compensation.
