Egypt's IP law sets trademark transfer rules and conditions
Egypt's Intellectual Property Protection Law specifies conditions for transferring trademark ownership, allowing transfer independently of the commercial business or exploitation project, according to rules set by the law's executive regulations. Article 88 states that transferring a business includes trademarks registered under the owner's name if closely linked to the business, unless otherwise agreed. If a trademark is excluded from the transfer, the owner may still use it for the same product categories unless agreed otherwise. Article 89 requires that trademark transfers, usufruct rights, or pledges be recorded in the register and published per executive regulations to be valid against third parties. Article 90 sets trademark protection at ten years, renewable for similar periods upon request during the final year, with a six-month grace period subject to a late fee not exceeding 500 Egyptian pounds.
