Delhi High Court: Booth Level Agents Not Liable for False Details in Voter Forms

The Delhi High Court ruled that booth level agents of political parties cannot be held liable for false details in electoral roll enumeration forms during the Special Intensive Revision, limiting their responsibility to verifiable information like photographs. Justice Amit Bansal stated BLAs are liable under Section 31 of the Representation of People Act only for information they can verify, such as matching a photograph to an elector's identity. The court ruled on a petition by Delhi Pradesh Congress Committee officials challenging the mandate requiring BLAs to certify all details personally. The court noted that verification responsibility rests with booth level officers under the SIR framework, and BLAs cannot verify information exclusively known to electors. However, BLAs remain fully responsible for forms of dead or shifted voters they complete themselves.
