Delhi HC: Booth agents liable only for verifiable info in electoral roll revision

The Delhi High Court ruled Thursday that booth level agents of political parties are not liable for verifying all details in enumeration forms during the Special Intensive Revision of electoral rolls. Justice Amit Bansal stated agents are liable only for verifiable information, such as matching the elector's photograph. The ruling came on a petition by Delhi Pradesh Congress Committee president Devender Yadav, who challenged the mandate requiring agents to give a personal undertaking certifying they verified all details. The court noted Section 31 of the Representation of People Act applies only to information agents can verify. The petitioners argued the undertaking requirement contradicts the statutory verification scheme under Section 23 of the Representation of the People Act, 1950, which assigns verification duties to Electoral Registration Officers. They contended the mandate unlawfully delegates statutory functions to private individuals.
