Andalusia's High Court upholds two-year prison sentence for sexual assault of 15-year-old in Benalmádena
Andalusia's High Court has upheld a two-year prison sentence for a young man convicted of sexually assaulting a 15-year-old girl at a home in Benalmádena in 2022, dismissing the defense's appeal in full. The court confirmed the original ruling, which found the then-18-year-old guilty of sexual assault against a minor under 16. The incident occurred after a group dinner, when the victim, who was intoxicated, became paralyzed and unable to react as the accused touched her. She required mental health treatment afterward. The sentence includes five years of supervised release, a restraining order, and €19,952.93 in compensation. The court applied a partial intoxication mitigating factor, noting the accused had consumed large amounts of alcohol, but found sufficient evidence to overturn the presumption of innocence.
